DMCA Policy

1 Designated DMCA Agent

SPLURJJ, LLC has designated the following agent to receive DMCA takedown notices pursuant to 17 U.S.C. § 512(c)(2):

This agent is registered with the U.S. Copyright Office DMCA Designated Agent Directory. Notices submitted to any other address may not receive a timely response.

2 How to Submit a Takedown Notice

If you believe that content on the Ooki platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Upon receipt of a valid notice, Ooki will act expeditiously to remove or disable access to the allegedly infringing content.

We take all copyright claims seriously. However, please be aware that submitting false or bad-faith DMCA notices may expose you to legal liability. See Section 8 for details.

3 Required Elements of a Takedown Notice

To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

• Your identity: Your full legal name, address, telephone number, and email address (or the contact information of the authorized copyright owner's representative).
• Identification of the copyrighted work: A description or list of the copyrighted work(s) you claim have been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
• Identification of the infringing material: The exact URL(s) on play.ookimusic.com where the allegedly infringing content is located, with sufficient detail for us to identify and locate it.
• Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Accuracy statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
• Signature: Your physical or electronic signature (typing your full name is sufficient as an electronic signature).

Incomplete notices may not be processed. We may contact you to request additional information before taking action.

4 Submit a Takedown Notice

Send your complete DMCA notice to our designated agent at dmca@ookimusic.com with the subject line DMCA Takedown Notice. Please include all required elements from Section 3.

5 Counter-Notice Procedure

If you believe your content was removed as a result of a mistaken or misidentified claim of copyright infringement, you may submit a counter-notice pursuant to 17 U.S.C. § 512(g)(3).

After Ooki receives a valid counter-notice, we will:

1. Forward a copy of the counter-notice to the original complainant.
2. Inform the complainant that we will restore the removed content in 10–14 business days unless the complainant files a court action against you.
3. Restore the content within that period if no court action is filed.

Warning: Submitting a counter-notice means you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if outside the U.S., any judicial district in which Ooki may be found.

6 Required Elements of a Counter-Notice

Your counter-notice must include:

• Your identity: Your full legal name, physical address, telephone number, and email address.
• Identification of removed content: The specific content that was removed and the URL where it appeared before removal.
• Good faith statement: A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
• Jurisdiction consent: A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located.
• Acceptance of service: A statement that you will accept service of process from the person who filed the original DMCA notice.
• Signature: Your physical or electronic signature.

7 Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Ooki maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

Our policy:

• First valid DMCA notice: The infringing content is removed and the user is warned.
• Second valid DMCA notice: The infringing content is removed and the user's upload privileges are suspended pending review.
• Third valid DMCA notice: The user's account is permanently terminated.

Ooki may deviate from this policy in cases of severe or egregious infringement, including immediate termination for: uploading content belonging to a major record label, commercial fraud, or uploading clearly counterfeit content. We reserve the right to modify this policy at our discretion.

8 False Claims Warning

Do not submit a DMCA notice unless you have a genuine, good-faith belief that your copyright is being infringed. Abusing the DMCA process as a tool to remove lawful content (including parody, commentary, fair use, or content you simply dislike) may expose you to legal liability and may result in your notice being rejected.

9 Content Restoration Timeline

Here is what to expect once we receive a valid notice or counter-notice:

• Takedown notice received: We will acknowledge receipt within 2 business days.
• Content removed: Valid takedown notices will result in content removal within 48 hours of receipt and verification.
• User notified: The account holder whose content was removed will be notified within 24 hours of removal.
• Counter-notice filed: We will forward the counter-notice to the original complainant within 2 business days.
• Content restored: If no court action is filed within 10–14 business days of the complainant receiving the counter-notice, we will restore the content.
